01Acceptance

What this is and what you're agreeing to

These Terms and Conditions are the agreement between you and Talkip, S.A. de C.V. ("Talkip", "we") for the use of the Talkip app and the talkip.app website.

By creating an account you accept these terms and our Privacy Policy. If you don't agree with anything written here, don't use Talkip.

02What Talkip is

A platform that connects, not a conversation service

Talkip connects two people by voice and charges for the call. The person you talk to is independent, not a Talkip employee.

Talkip is a marketplace where one person opens a booth, sets a topic, a price and a duration; and another person calls and pays for that block of time.

Talkip is only the technology intermediary. We don't provide the conversation service, we don't take part in calls, we don't supervise them, and we are not a party to the agreement between the caller and the person who answers.

Booth owners are independent individuals: they are not employees, partners or representatives of Talkip. Each of them decides what they talk about, how much they charge and when they go live. Talkip does not guarantee the quality, accuracy, usefulness or outcome of any conversation.

03Who can use Talkip

Account requirements

Adults over 18 only, with real information, one account per person.

  • You must be 18 or older. Talkip is not available to minors under any circumstances.
  • Your profile information must be real. You may not impersonate anyone or use someone else's photo, name or identity.
  • Your account is personal and non-transferable. You may not sell, lend or assign it.
  • You're responsible for what happens in your account and for keeping secure the email you sign in with.

Creators must verify their identity through our verification provider before they can go live and receive payments.

04How calls work

Blocks of time, not loose minutes

You buy a full block, not minutes. You get 25 seconds at the start to hang up free of charge. If the creator hangs up, you're not charged.

Each booth defines a block: a fixed duration and a fixed price for that block. When you call, you're contracting that whole block, not individual minutes.

Grace window

Once the call connects you have 25 seconds to hang up at no charge. It's there for cases where the connection fails, the audio doesn't work, or you immediately realise the booth isn't what you were looking for. After that window, the full block is charged.

Who ends the call

Some booths offer free calls. Those carry no charge at all and end on their own when the time runs out.

Calls depend on your internet connection and on the other person's. Talkip does not guarantee that every call will connect, nor the audio quality.

05Prices and charges

What it costs and how it's charged

Each creator sets their own price and you see it before you call. The charge is authorized before and captured when the call ends.

The price of each block is set freely by the booth owner, within the limits the platform enables for their level. You always see the price and the duration before calling.

Before the phone rings, a charge is authorized on your payment method to reserve the amount of the block. That amount is only captured if the call takes place and is chargeable under section 04. If it isn't chargeable, the authorization is released.

All prices are expressed in US dollars (USD). Your bank may apply its own currency conversion or fees, over which Talkip has no control.

Payments are handled by our payment processor. Talkip does not store your card details.

06No refunds

The other person's time has already been given

There are no refunds for a conversation you didn't enjoy. The creator already gave you their time. That's what the 25-second window and the ratings are for.

Once a call has been charged, there are no refunds. The creator set aside and delivered their time, and that time cannot be returned.

Specifically, no refund is given when:

  • The conversation didn't meet your expectations or you didn't enjoy it.
  • You disagreed with the other person's opinions or information.
  • You hung up before the block you purchased ran out.
  • You forgot to end the call and the time ran out.

Before contracting, you have tools to decide: the price and duration in plain sight, the booth's description and topic, its intro audio or video, and other users' ratings. And once the call has started, you have 25 seconds to leave at no cost.

If you believe there's been an incorrect charge — for example a call that never happened, a duplicate charge, or an amount different from the one shown — write to support@talkip.app within 30 days and we'll review it. An incorrect charge is not the same as a refund for dissatisfaction.

07If you have a booth

Commission and creator payouts

Talkip keeps 20% of each call. Processor fees are borne by the creator. Funds are released after 30 days and paid in the following biweekly cycle.

Commission

Talkip keeps a 20% commission on the amount of each charged call, for the use of the platform, the calling infrastructure and the payment processing.

In addition, the payment processor's fees applicable to each transaction are deducted from the creator's share. Those fees are set by the processor, not by Talkip, and may vary by country and payment method.

When you get paid

  • The amount of each call is held for 30 days from the time it's charged. That's the window in which the paying user may raise a claim or a chargeback.
  • Once that period has passed, released amounts are paid out in the following biweekly cycle.
  • The minimum amount for a payout is 20 USD. If your released balance doesn't reach it, it rolls over to the next cycle.
  • Payouts are made through our payment processor, to the account you've registered and verified.

Chargebacks and claims

If a user disputes a charge with their bank and the dispute succeeds, the corresponding amount is deducted from the creator's balance, even if it had already been released or paid out. In that case the amount is offset against their following payouts. Talkip does not absorb chargebacks arising from calls delivered by third parties.

We may withhold an account's payouts, in whole or in part, while a dispute, a report or an unusual pattern of activity is investigated. The hold is lifted once the review concludes, and any amounts found legitimate are paid in the following cycle.

Fraudulent conduct

Generating artificial calls in order to obtain payouts is strictly prohibited: arranging charges with another person, using your own or third-party accounts to call yourself, or using payment methods that don't legitimately belong to the caller.

Where we detect this kind of conduct, the account is cancelled immediately, pending payouts related to that activity are cancelled, and we reserve the right to claim damages and to report the matter to the competent authorities.

Creator obligations

  • You are an independent individual providing your own service. No employment relationship with Talkip exists.
  • You are responsible for your own tax obligations on the income you receive.
  • You must provide correct details to receive your payouts. Talkip is not liable for failed transfers due to incorrect details.
  • You must attend the calls you accept and honour the time contracted.

08Rules of conduct

What isn't allowed on Talkip

Nothing sexual, nothing illegal, no harassment, no minors. And don't take the conversation off the app to avoid the commission.

By using Talkip you agree not to:

  • Publish or transmit sexually explicit content, or offer services of a sexual nature.
  • Harass, threaten, insult, discriminate against or intimidate another person.
  • Use the platform if you are a minor, or interact with minors through it.
  • Offer, promote or carry out illegal activities of any kind.
  • Impersonate anyone or misrepresent your identity.
  • Publish content that isn't yours or that you don't hold rights to.
  • Record a call without the other person's consent.
  • Share another user's personal data, or the content of a private conversation.
  • Request or make payments outside Talkip to avoid the commission, or move the conversation to another platform for that purpose.
  • Use the platform for unauthorized advertising, investment schemes, fraudulent sales or chain schemes.
  • Manipulate ratings, create multiple accounts, or attempt to compromise the platform's systems.

Also, although these terms don't prohibit it: what's said on a call is not professional advice. No conversation on Talkip replaces the opinion of a doctor, lawyer, psychologist or financial adviser. Each user is responsible for the decisions they make.

09Your content

What you publish stays yours

Your photo, audio and video are yours. You give us permission only to show them inside the app.

The content you publish — profile photo, cover, description, intro audio and video — remains yours. By publishing it you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display it within Talkip in order to operate the service. That licence ends when you delete the content or your account, except for temporary backup copies.

You confirm that you have the right to publish everything you upload and that it doesn't infringe third-party rights.

Content you upload may be analyzed automatically before it's published. We may reject, remove or hide content that breaches these terms, without prior notice.

The Talkip brand, its logo, the app's design and its software are the property of Talkip and may not be used without written authorization.

10Suspension and account closure

When we can close the door

If you break these terms we can suspend or close your account. In serious cases, immediately and without notice.

We may suspend or cancel your account, temporarily or permanently, when:

  • You breach these terms or the rules of conduct.
  • We receive well-founded reports about your behaviour.
  • We detect fraud, manipulation of charges or the creation of multiple accounts.
  • Your conduct puts other people or the platform at risk.
  • A competent authority requires it.

For serious breaches — sexual content, involvement of minors, harassment, fraud or illegal activity — suspension may be immediate and without prior notice.

If your account is closed for a breach, you keep the right to payment for calls legitimately delivered before the suspension, unless they're related to the conduct that caused it. No compensation of any kind arises.

If you think a mistake was made, write to support@talkip.app and we'll review your case.

You can also close your account whenever you want from the app's settings.

11Liability

How far Talkip is responsible

Talkip connects the call; it isn't responsible for what's said on it or for decisions you make based on a conversation.

Talkip is provided "as is" and "as available". We work to keep the service running well, but we don't guarantee it will be free of interruptions, errors or connection failures.

To the extent permitted by law, Talkip is not responsible for:

  • The content, accuracy or consequences of anything said on a call.
  • Decisions you make based on a conversation.
  • The conduct of other users, on or off the platform.
  • Indirect or incidental damages, lost profits or lost opportunities.
  • Failures of your internet connection, your device or third-party services.

In any case, and where the law allows liability to be limited, Talkip's total liability to you will not exceed the amount you paid through the platform in the three months prior to the event giving rise to it.

Nothing in this section limits liabilities that the law does not allow to be excluded, nor the rights available to you as a consumer.

12Changes

These terms may be updated

We may change these terms to reflect changes in the service, in our providers or in the law. The date of the last update appears at the top.

If a change is significant, we'll notify you inside the app before it takes effect. If you keep using Talkip after that date, you're understood to accept the new version. If you don't agree, you can close your account.

13Governing law

Which law applies and where disputes are settled

These terms are governed by the laws of the United Mexican States.

For any dispute, the parties submit to the competent courts in Mexico, waiving any other jurisdiction that might correspond to them by reason of their present or future domicile, except where the law of your country of residence provides otherwise in your favour as a consumer.

Before going to legal proceedings, please write to us: most matters are resolved directly.
